The Judge lawfully exercised discretion under Order 62 r 6(2) and Re Buckton to order that the costs of commencing the originating summons up to the point of proper disclosure be paid personally by the executor because the executor unreasonably delayed disclosure, while separately ordering that the estate reimburse the trustee for costs of preparing disclosed documents; the renewed application failed to show an arguable case that the Judge's discretionary decision was plainly wrong and is therefore dismissed.
