The Court held that the word 'individual' in Order 81 r.9 does not include a body corporate; therefore the Rule could not be used to sue a limited company by a firm name and service on 'Survival Technology (a firm)' was a nullity; consequence: the appeal succeeds and the trial judge's orders are set aside except for the attachment order which remains in effect subject to consequential directions.
