The Court ordered that the net proceeds of sale of the NT Property be paid into Court because there was a real risk the Plaintiff's share of the estate would be insufficient to meet the Executor's counterclaim and because of the Plaintiff's obstructive conduct; costs of the summons were ordered to follow the event in favour of the Defendant, except that costs relating to the Court's letter dated 23 March 2021 (including one hour of hearing time) were to be costs in the cause and the Defendant's trustee-basis costs of the summons were to be paid out of the estate.
