The Court of First Instance had jurisdiction to determine the originating summons; the defendant's alleged agency fee and related defence were not supported by credible documentary or evidential material and did not raise a reasonably arguable or triable issue; accordingly the court determined on the originating summons that the defendant was indebted to the plaintiff as claimed and summary determination was appropriate.
