Applying Fung Kam Cheung v Kwok Yiu Wing, the court inferred from long, uninterrupted possession of the lots by the Tso and the 1st Plaintiff and the absence of any disturbance or demand by the mortgagees or their representatives that the 1905 mortgage is incapable of subsistence or otherwise unenforceable, and accordingly granted a declaratory order to that effect.
