The evidence did not raise a triable issue that the Intervener was the sole beneficial owner: contemporaneous documents (mortgage application and bank statements) contradicted the Intervener's and Defendant's assertions of sole funding; the Intervener's alleged payments were insufficient to establish exclusive beneficial ownership and he had been effectively silent to the Plaintiff; accordingly the Legal Charge is enforceable against the Property and the Intervener's appeal is dismissed.
