The court has jurisdiction and discretion to vary the earlier consent validation order; credible evidence established a prior common intention permitting a lump sum withdrawal and that the withdrawals were in the ordinary course of business of a solvent company; the slip rule could be invoked to reflect that intention; accordingly the reliefs sought (HK$6,000,000 lump sum and increase of monthly limit to HK$2,200,000) were to be granted with terms and costs to be settled with counsel.
