The Court of Appeal held that the Law Society, having issued a certificate under Rule 3(2) indicating the applicant 'appears to be qualified' (except as to examinations), was not entitled subsequently to refuse the certificate of eligibility on the ground that the applicant lacked the professional experience required by Rule 4(2)(b); the statutory scheme requires the Society to decide the 'appears to be qualified' question at that stage and it cannot lawfully re-open that determination after allowing the applicant to sit and pass the examinations.
