Leave to apply for judicial review was granted because the applicant's contentions were reasonably arguable: the legal question whether deployment restrictions equate to impairment of operational efficiency under Order 8 requires further examination in light of Lam Siu Po, and there was a real prospect that the Adjudicating Officer equated restrictions per se with impairment contrary to the required causal and evidential approach.
