There were no grounds to treat the applicant's abandonment of his earlier application for leave to appeal as a nullity; accordingly that application is dismissed, and the belated application for leave to appeal against sentence over twelve years out of time is also dismissed; complaints about continued psychiatric treatment lie with the Hospital Authority.

The magistrate accepted the victim's account, rejected the appellant's self-defence claim, and on uncontradicted psychiatric evidence of paranoid schizophrenia and high propensity for violence convicted under s.19 Cap.212 and imposed a six-month hospital order under s.45(1) Cap.136 as appropriate.
