Although the trial judge had borne the mitigating factors in mind, the Court allowed the appeal and reduced the custodial sentence because the gross disparity with a co-conspirator in the same transaction (But Yu Pui) rendered the original two-year sentence inappropriate; the proper remedy was to quash the two-year sentence and substitute one year.
