On the balance of probabilities the transaction was, in substance, a mortgage secured by the property notwithstanding the form of an absolute assignment with an option; mutuality and reciprocity existed such that equity treats the arrangement as a mortgage and the defendant is entitled to have the premises re-assigned on payment of the principal and interest under the terms ordered by the court.
