Although common law may sever privity of estate when a tenant sublets the whole premises, a Part II tenancy is governed by the Landlord and Tenant (Consolidation) Ordinance which treats the principal tenant as 'landlord' of a sub-tenant for statutory purposes and preserves the Tribunal's jurisdiction; on the facts no subletting was established and the applicant's claim failed.
