The dismissal was not a valid reason under s32K because the employer failed to take into account material circumstances required by s32L, notably the plaintiff's proximity to qualifying service and the lack of consideration of lesser sanctions and a fair disciplinary process; accordingly the plaintiff was entitled to terminal payments under s32O and to the contractual end of year bonus, while no separate damages for breach of mutual trust and confidence were awarded.
