On the parties' agreed terms and having been satisfied the proposed course was appropriate, the court granted leave, issued an order of certiorari quashing the Appeal Board's decision, extended time for the application, and remitted the appeal to the Appeal Board for fresh consideration; no order as to costs was made.

Art 4 must be construed as referring to the parents nationality at the time of the child s birth; a parent s subsequent naturalisation does not automatically confer Chinese nationality on a child born non-Chinese; the NPCSC Explanations do not operate to permit automatic conferral or general dual nationality in such circumstances; applicant therefore is not a Chinese national and may only seek naturalisation under Arts 7 and 8.

Passport issuance is an exercise of the Royal prerogative that does not give rise to a legal right enforceable by mandamus; because the decision is not judicial and no enforceable right existed, the court must dismiss the application to compel issuance of a passport.
