No PA CICT was established because there was no contemporaneous or reliable evidence of the alleged 9 April 2015 agreement, the Plaintiff’s case changed materially from earlier pleadings and contemporaneous documents (including WhatsApp and a statutory declaration) contradicted the asserted arrangement, payments by Bo were found to be rent paid to the Defendant as landlord, and overall credibility and inherent probabilities favoured the Defendant as sole beneficial owner; accordingly the Plaintiff’s claim was dismissed and the Defendant’s counterclaim succeeded.
