The Judge misapplied the discretion by failing to give adequate weight to the merits of the defendants' defences; on appeal the default judgment against Lee was set aside unconditionally and the charging orders discharged unconditionally, while the default judgment against Globalmax was set aside on condition that Globalmax pays into court HK$710,000; costs were reallocated accordingly.
