The court accepted that the mortgagee could not be found and that, although there was an arguable inference the customary mortgage had been discharged, insufficient admissible evidence existed to conclusively establish discharge; accordingly the court granted leave under s.12A to pay HK$1,000 into court as sufficient to redeem the mortgage, ordered publication of an advertisement giving interested persons 14 days to apply, allowed a paper application for declaration after 21 days from publication, and made no order as to costs.
