On the proved facts the driver was not negligent: he was proceeding slowly with green lights, the deceased apparently dashed from between stationary vehicles to the driver's right and appeared at the edge of the driver's lateral vision so that even earlier observation could not have prevented the impact; therefore the defendant was not liable and the plaintiff's claim is dismissed.
