The proceedings were dismissed because the delay in prosecuting the judicial review was inordinate and inexcusable amounting to an abuse of process, service could properly be dispensed with given inability to locate the applicant, and the constitutional point no longer had utility as it had been conclusively determined by the Court of Final Appeal in Vallejos; accordingly dismissal and costs following the event were justified.
