Given the admitted facts — existence of an insurance policy, the driver's Indian licence entitling him to class 2, the subsequent administrative addition of class 2 to his Hong Kong licence and the domestic use of the vehicle — these matters constitute special reasons engaging the court's discretion; on exercise of that discretion it was unjust to impose the mandatory 12‑month disqualification and the disqualification order was quashed while fines were upheld.
