The magistrate's adverse credibility findings and the adverse inferences drawn from the appellant's interview were open to him on the evidence; the prosecution proved both offences beyond reasonable doubt; there were no special reasons to depart from the statutory minimum disqualification under Cap 272 s4(2)(a); therefore the appeal was dismissed and convictions and penalties upheld.
