The magistrate properly treated the quantity as creating a latent risk that some drugs might be used by others, gave credit for the guilty plea, and did not imply she rejected personal consumption; therefore the 18‑month immediate imprisonment sentence was appropriate and the appeal against sentence is dismissed.

In absence of an adverse finding on whether the heroin was for personal consumption, the Court of Appeal must adopt the version most favourable to the applicant, apply an appropriate additional mitigation discount and reduce the sentence from four years to three years' imprisonment.

Maintaining a stock of drugs for one's own consumption is not procuring or dealing and therefore does not satisfy the statutory presumption of possession for the purpose of trafficking; accordingly the trafficking conviction was erroneous and must be quashed and substituted with a conviction for simple possession with a reduced sentence.
