    The court refused the Plaintiff's application at the first stage because the material before the court did not demonstrate evidence which, if unanswered, would likely lead to a wasted costs order. CSC's conduct amounted at worst to a clerical or procedural mistake, the steps taken were necessary for determination of the guardian ad litem application, and subsequent events (Legal Aid certificate, acknowledgements and conduct of parties) removed any causal link to wasted costs; accordingly no basis existed to proceed to the second-stage or to make a wasted costs order.
