Leave to appeal was granted on the question whether 'damage sustained within the jurisdiction' under Gateway F includes indirect or consequential damage (Question 1) and additionally on the applicability and consequences of section 33(d) of Cap 365 (new Question 2); the application for leave in respect of the Board's contention about treating UK Supreme Court obiter as binding was dismissed because the CA's remark had been clarified and the correct position is that UKSC obiter is persuasive but not binding.
