The court held that the use of TAR for identifying and prioritising relevant electronic documents is permissible and does not require prior court sanction in every case; parties should agree methodology where possible and the court will make case management directions where an application is made. Applying those principles the court approved the proposed limited discovery protocol with a modification to the timetable and ordered discovery to be completed by 4:30pm on 31 October 2022, with costs to the Liquidators in the cause.
