The Court held that although the trial judge should not have said he had admitted the statements, the admission and the summing-up fell within judicial discretion and did not prejudice the applicant; breaches of guidance rules did not make the conviction unsafe and the conviction on the second count was not perverse, therefore the appeal was dismissed.
