The court found on the documentary payroll and manufacturing records and supporting export certificates that the blouses were manufactured in Hong Kong, so there was no triable issue on place of manufacture and summary judgment for the contract price was correct; however the plaintiff's claim for lost profits arose from alleged statements that the blouses were not made in Hong Kong and thus amounted to defamation, which falls within Ord.14 r.1(2) exclusion, so the part of the summary judgment awarding loss of profits was set aside.
