Although the court accepted that the construction question regarding when a licence is required raised a matter of great general or public importance, it refused leave because the intended appeal was not reasonably arguable: the Court of Appeal upheld its statutory construction rejecting Lam J's views and found no persuasive basis in the Commissioner's submissions to change that view; consequently leave to appeal to the Court of Final Appeal was refused and costs were awarded to the applicant (original appellant).
