The court preferred the applicants direct evidence over the defendants, found on balance that the applicant was injured in the course of employment by Sunrise/Mr Amir at a site where Sunrise was performing Kaiser's sub-contracting work, held Kaiser jointly liable under s 24, substituted the Boards 1% assessment with 3% for permanent loss of earning capacity based on medical opinion and vocational factors, awarded agreed s10 and s10A sums, ordered interest and costs, and held Kaiser entitled to indemnity from Sunrise and Mr Amir.
