Both summonses were dismissed and the interveners' late Replies expunged because the applications were extremely late, inadequately explained, introduced materially different factual grounds inconsistent with pleaded claims and would cause prejudice and risk aborting a fixed trial date; accordingly discretion to allow late filings was refused.
