The court refused to vary the costs order nisi because the plaintiff succeeded on the Quistclose trust claim which was pleaded as an alternative, the defendant failed to demonstrate it had made requisite enquiries or sought directions as a charity before contesting, weaknesses in the plaintiff's case did not justify depriving him of costs, and the defendant's settlement proposal did not render its contest reasonable; accordingly the costs order nisi was made absolute.
