Where a developer bona fide proposes to include land in a redevelopment the land forms part of the site for plot ratio/site coverage calculations; narrow pavements under 4.5m are deemed not to be 'streets' under Regulation 23(1)(c) and therefore are not excluded by Regulation 23(2)(a); on the facts the Building Authority's refusal was erroneous in law and the applicant may include the former service lane and proposed pavements in site area calculations.
