The Tribunal held that the relevant redevelopment scheme was represented by the 1977 amended plan only and therefore did not apply the Pointe Gourde exclusion to the effects of the 1976 plan; regression (linear) analysis for pedestrian flow was not accepted absent profession-wide adoption; valuation must rely on adjusted comparables, zoning where appropriate, a 20% p.a. time adjustment accepted for this case, proper deferment/discounting applied for scheme effects, and resulted in an open market compensation award of HKD 1,425,000 to the Claimant.
