- Case number
- CACV34/1997
Majority: Section 30 of the Police Force Ordinance, requiring police officers to obey all lawful orders of superior officers, when read in the statutory and practical context of police discipline, displaces the common law privilege against self-incrimination/right to silence in internal disciplinary investigations by necessary implication; therefore refusal to answer lawful orders in that context can constitute misconduct and the disciplinary tribunal's finding was not vitiated by illegality. Appeal dismissed.
