Because no reason for the Police Supervision Order was given and the record contained no justification, the appellate court allowed the appeal in respect of the supervision order and quashed it while leaving the custodial sentences intact.

Convictions for the three charges were upheld because there was clear admissible evidence; however the aggregate sentence of three years was excessive in the circumstances and was reduced so that the total term of imprisonment became two years, taking into account the Police Supervision Order, the appellant’s antecedents and the statutory constraints of s.22 of the Societies Ordinance.

The concurrent two-year sentences were appropriate given the offences and the appellant's extensive criminal record, and the Police Supervision Ordinance order made under s.31 by the Governor-in-Council is an executive act which this court cannot entertain on appeal.
