The magistrate lawfully assessed the interview record and rejected the appellant's claim of genuine belief in consent as not credible; the cumulative nature and sexual character of the touching were objectively indecent and proved the offence beyond reasonable doubt; appellate intervention was unnecessary as there was no irrationality or material error in the factual findings.

The combination of possession of implements adapted for robbery and the applicant's clear admissions in a videotaped interview provided a reasonable basis to infer an intention to commit robbery/burglary; the trial judge's adverse credibility finding was properly reached and therefore the conviction was upheld and leave to appeal refused.
