Although the judge's direction referenced the means of killing (strangulation) rather than adopting the ideal 'killing simpliciter' formulation, in the context of the trial there was no real risk the jury would engage in the impermissible proportionality reasoning identified in Liang Yaoqiang; accordingly leave to appeal was refused and the conviction was not disturbed.
