The trial judge's overall directions were adequate and fair; the alleged admissions were properly admitted as voluntary; the jury, entitled to disbelieve the applicant, had sufficient evidence to find possession for trafficking; there was no miscarriage of justice warranting leave to appeal, so the conviction and sentence are upheld.

On the whole of the judge's directions and the evidence, the directions were neutral, comprehensive and fair; inconsistencies in police evidence were adequately identified and could reasonably be resolved in favour of the police by the jury; there was no evidential or legal basis to conclude the trial was unfair, therefore the leave application against conviction is refused and the conviction stands.

The magistrate's acceptance of the police officer's evidence and rejection of the appellant's and co-defendant's accounts on credibility was open on the evidence and not vitiated by error; therefore there was no basis for the appellate court to interfere with the conviction.

Leave to appeal was dismissed because the trial judge gave a thorough and fair summing-up, the jury properly considered the contested matters, the trial judge acted within her discretion regarding counsel and adjournments, and the additional/new evidence relied on by the applicant would not have affected the verdict.
