Because the first respondent continued to operate an unregistered clinic dealing in substantial quantities of Part I poisons after having been fined once, fines were inadequate; imprisonment was necessary for deterrence and public protection. The second respondent, aware from prior conviction, merits imprisonment for one month; the third respondent's fine should be increased with a default custodial term if unpaid.
