The Court upheld the trial judge’s acceptance of the police and taxi driver evidence that the applicant discarded the packet and found that the conviction was not unsafe; the absence of fingerprints/DNA was not determinative; the sentence of 7 years fell within the R v Lau Tak Ming guideline and therefore ought not be disturbed.

The trial judge misdirected the jury by inviting adverse inference from the defendants' failure to disclose their defences to police before trial, which exceeded permissible comment; nevertheless, because the circumstantial and forensic evidence against the appellants was strong, the Court applied the proviso to s.83(1) Criminal Procedure Ordinance and refused the applications for leave to appeal, upholding the convictions.

The magistrate relied on an erroneous assumption about the number of similar previous convictions which materially influenced the twelve month sentence; on that basis the sentence was set aside and substituted with a nine month term.

The sentences on the two charges arose from one and the same act of possession and therefore the proper disposition is to order the sentences to run concurrently, resulting in an aggregate sentence of six months imprisonment.
