The court reduced the appellant's sentence to six months because the forged documents were not used and the appellant could be treated similarly to her co-defendant as a passenger in transit; however, the court emphasised that offences involving forged BNO passports are serious and that concurrent sentences are not inevitably appropriate where misrepresentation is a separate offence.

The judge erred by imposing consecutive sentences for offences that formed part of the same criminal activity; the correct approach is to fix an overall starting point (here 6 years) and then apply a one-third reduction for the early plea and cooperation, resulting in concurrent sentences of 4 years on each count.

The judge was justified in treating the passport offences of D2 and D3 as separate and distinct and in imposing consecutive sentences; their appeals were refused.
