The defence failed to prove on the balance of probabilities that the appellant honestly believed the Ordinance had been complied with or that he took all reasonable steps under s17(11) to prevent the offence; accordingly the offence of dealing with dutiable commodities was proved beyond reasonable doubt and the magistrate's conviction is upheld.
