Where an executor sells property in the course of administering the estate, a purchaser is entitled to presume the sale is for administration and is protected unless there is evidence that administration is complete or that the sale is in breach of trust; clause 5 of the will and s54 PAO do not displace that presumption, and the vendor's answers to requisitions were sufficient, therefore the purchasers breached the contract and vendor may forfeit the deposit and recover damages.
