Section 16(1) and 16(1A) did not apply to the respondent's proposal in the circumstances and there is no express provision in section 16 empowering the court to order joint expert examination; notwithstanding that, for proper case management the court exercised its case management powers under PD18.1/PD18.2 to order disclosure of medical records and to give detailed directions and a timetable for arranging joint orthopaedic expert examination and a joint expert report, and adjourned the application sine die with liberty to restore subject to compliance with those directions.
