The court preferred the plaintiff's orthopaedic expert (Dr Tsoi) over the defence expert and found the accident caused the shoulder contusion and aggravated previously asymptomatic degenerative conditions of the elbow and spine; applying that medical conclusion the court quantified damages (PSLA, past and future earnings, MPF, loss of earning capacity and special damages), adopted a reduced multiplier of 4 for future loss, allowed selected bonesetter expenses, deducted ECC payments and ordered interest and costs accordingly.
