The court granted the plaintiffs' oral application to vacate the trial and transfer the action to the High Court; the judge expressed a tentative view that where a damages claim in a water leakage case is within the District Court's monetary limits the court can likely exercise ancillary equitable jurisdiction under DCO s48 to grant repair injunctions irrespective of the s52 rateable value threshold, but declined to decide the point finally because of existing conflicting authority and the binding nature of higher court decisions.
