The Court of Appeal held that where amendments allowed at trial introduce fresh heads of damage not adequately notified before trial the judge should exercise costs discretion by reference to the case as originally pleaded; applying Cheeseman the defendant was entitled to his costs from the date of the payment into Court (23 March 1988); the trial judge's blanket award of costs to the plaintiff was varied accordingly and the cross-appeal dismissed.
