The court held that the SRO does not automatically displace the contractual disciplinary regime established by the HKIS Bye-Laws; membership creates voluntary contractual obligations enforceable absent clear statutory language to the contrary, and Rule 4.2.2 does not mandate immediate provision of the Case upon formation of a Committee of Investigation so the complaint was premature; accordingly the judicial review was dismissed.
