The issues and claimed reliefs are within the competence and monetary jurisdiction of the District Court/Family Court and are not of such legal or factual complexity as to require retention in the Court of First Instance; preliminary views expressed by the original family judge do not establish bias sufficient to deny transfer; accordingly the action is to be transferred to the Family Court.

Given uncertainty about the Petitioner's current expenses in the Philippines and the Respondent's constrained finances, but applying the broad‑brush approach under s.3 and the principle that a payer able to borrow for himself may borrow to meet maintenance, the court awarded limited interim maintenance of HK$4,500 per month and refused an order for litigation funding because the Petitioner has some assets and should apply for Legal Aid; costs reserved and further directions given.

The Court of Appeal allowed the wife's appeal, holding the judge below erred in finding Germany to be distinctly more appropriate. Hong Kong has the most real and substantial connection to the marriage and proceedings; the husband failed to discharge the burden to show Germany was clearly more appropriate; the wife would face juridical disadvantages under German law and procedure; consequently the stay was wrongful and must be discharged.
